07.09 Product Liability Insurance, Recall Cost Model and Financial Contingency Plan

Governance metadata | Owner: Head of Finance/Legal | Last reviewed: 2026-10-22 | Next review: 2027-01-31

The response process is in 07.05; this document adds insurance, retention, how much a single recall burns, and where the money comes from. Insurance and statutory thresholds are subject to written confirmation from legal counsel / the broker.

⚖️ Compliance currency note (conservative basis): this document is an operating methodology and does not constitute legal advice. Statutes, certifications, tariffs, and insurance terms are governed by the official texts and by written confirmation from your legal counsel / customs counsel. It is recommended that legal / customs re-review this chapter quarterly; any content not marked "confirmed by legal" must be checked against the currently effective version and its implementation date before execution.

1. Insurance Layering (Conceptual Defaults)

LayerCoverageKey questions
Product liability insuranceThird-party bodily injury / property damageGeographic scope? SKU description? Annual limit?
Recall expense insuranceDirect recall costsDeductible? Does it include transport and destruction?
Cyber / privacyBreach-relatedFines are usually not covered
Product completion / qualityPartial extensionsDoes it overlap with PL?

Before GR3: finance + legal confirm that the cover is in force; without insurance in place, the business must not internally describe the risk as "recall risk covered".

Total cost ≈ Units recalled × Per-unit handling + Logistics and warehousing
+ Customer service, PR, legal + Channel compensation / fines
+ Brand damage (shown separately as a sensitivity)

Per-unit handling bands:
  OTA repairable USD 0–5/unit
Ship back, mainboard swap USD 40–120/unit
  Whole-unit swap / scrap USD 120–250/unit

A major recall is booked on its own line and is never mixed with the routine 3% RMA (07.06).

4. GR Gate Criteria

8. RMA / Repair Network Capacity

When recalling 5,000 units for mainboard swaps, check the weekly capacity of the 06.05 repair depot; if it is insufficient, run the replacement + B-Stock strategy in parallel to avoid a second wave of complaints.

9. Financial Statement Presentation Recommendations

  • Recall provisions: a separate line
  • Insurance recoveries: recognized conservatively (legal opinion)
  • It is prohibited to hide recall spending inside "marketing expense"

11. Repair Capacity vs. 06.05

Recall mainboard swaps: ask the repair depot's weekly capacity first; if it is insufficient, prioritize replacement and take the old units back afterwards.

  6. Does it cover a "regulatory mandate"?
  7. Exclusions: expected losses, known defects, fines?

25. Cross-Check with 03.07

  • [ ] The mandatory insurance question list has been sent to the broker

  • [ ] Defect grading has been aligned with quality

  • [ ] The SQE→recall escalation path has been drilled
